Website E-Commerce Policies

These policies are published to comply with standard e-commerce and payment gateway requirements for Earlybird Educare at Work (Pty) Ltd (trading as Earlybird Educare), operating at www.earlybirdeducare.co.za.

1. Introduction & Terms of Use

By using this website and the online payment gateway, you agree to the terms and conditions set out below. These terms apply to the payment of registration fees for enrolment at Earlybird Educare centres.

2. Delivery Policy

Earlybird Educare provides centre-based early childhood development services. As such, “delivery” pertains to the confirmation of your child’s enrolment space rather than the shipping of physical goods.
● Enrolment Confirmation: Upon successful payment of the registration fee and the completion of all other enrolment requirements, the Principal of the relevant centre will send a formal enrolment confirmation message via WhatsApp.
● Provision of Physical Items: The registration fee covers direct enrolment costs, including a T-shirt, bag, bed linen, and stationery. These items are not shipped via courier but are issued directly to the parent/ child at the respective Earlybird Educare centre during the first year of enrolment.

3. Refund Policy

Families must be certain of their intention to enrol before making payment. The registration fee
covers administrative processing and direct enrolment costs (as detailed above).
● Non-Refundable: The registration fee is strictly non-refundable and does not constitute a deposit toward future tuition fees.
● Exception (Application Rejection): The only exception to this policy is in the event that Earlybird Educare formally rejects an enrolment application, in which case the registration fee may be refunded depending on the specific circumstances.

4. Return Policy

Due to the nature of our services, standard e-commerce return policies for shipped physical goods do not apply. Any physical items provided as part of the registration fee (such as apparel

or stationery) are issued in person at the centre. Should any of these items be defective upon receipt, they will be exchanged at the centre in accordance with the Consumer Protection Act (CPA).

5. Cancellation Policy

The cancellation of an existing enrolment is governed comprehensively by the formal Enrolment
Contract signed by the parents/ guardians during the intake process.
● Notice Period: Earlybird Educare requires one full calendar month’s written notice for disenrolment.
● Reasoning: This notice period is strictly enforced to allow the centre sufficient time to offer the open space to another family on our waiting list.

6. Privacy Policy

Earlybird Educare at Work (Pty) Ltd is committed to protecting your privacy and complying with
the Protection of Personal Information Act (POPIA).
● Information Collection: We collect personal information (including names, contact
details, and specific details pertaining to minors) solely for the purpose of processing enrolments, communicating with parents, and providing safe and effective early childhood development services.
● Data Protection: Your information is stored securely and is only accessible to authorised
personnel. We do not sell or share your data with third parties for marketing purposes.
● Payment Gateway: Online credit card payments are processed securely by our approved third-party payment gateway. Earlybird Educare does not store your raw credit card details on our local servers.

7. Governing Law and Jurisdiction

This website, any online transactions, and these policies are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the South African courts in respect of any disputes arising in connection with the website or these terms.
